Welcome to the Blackbird Tees website. Please review the following terms that govern your use and purchase of products from our site.  All services from Blackbird Tees to you, the customer, are carried out based on these general terms and conditions. Note that your use of our site constitutes your agreement to follow and be bound by these terms. These Terms and Conditions May Change

Blackbird Tees (blackbirdtees.com) reserves the right to update or modify these terms and conditions at any time without prior notice. Your use of our site following any such change constitutes your agreement to follow and be bound by the terms and conditions as changed. For this reason, we encourage you to review these terms and conditions whenever you use our site.

Standard Terms 

• The “offers“ contained on the Blackbird Tees website represent a non-binding invitation for the customer to place an order with Blackbird Tees. 

• By completing an order on our site, the customer makes a binding offer for a contract of sale. Blackbird Tees sends an order confirmation via e-mail to the customer. The order confirmation does not represent an acceptance of the offer, but shall only acknowledge to the customer that their order was received by Blackbird Tees. The contract is only accepted when Blackbird Tees ships the ordered product to the customer and confirms the shipment of goods to the customer in a second e-mail.

• Blackbird Tees reserves the right to reject any received orders for any reason with notice to the customer. 

• The contract ends with the complete delivery to the customer supplied address through Blackbird Tee’s shipment provider. If there is an interruption of delivery, and Blackbird Tees fails to cover a congruent substitute transaction in a business reasonable timeframe, the customer shall be informed immediately about the non-availability of the service. In the case of the customer having already paid, then the funds paid shall be refunded.

 Delivery and Shipment Terms 

• The delivery will be shipped within two weeks, but this time frame is listed for rare circumstances when shorter delivery times are not possible. Normally, goods are shipped within a few days. Delivery times and terms of delivery shall only be binding insofar as Blackbird Tees has expressly agreed to such in writing. Typical, delivery times are 2-4 days, but can take up to 2-3 weeks in certain circumstances.

• Delivery shall be conducted by a shipment service provider chosen by Blackbird Tees. The customer has to pay standard shipping costs which may depend on order value, and where the order is shipped to.  Prices 

• The customer is responsible for shipping and handling charges, which may vary depending on order value as well as delivery location. Current shipping prices can be viewed at http://www.blackbirdtees.com/store/index.php?main_page=shippinginfo 

• For customers from outside the United States, including Canada, all stated prices are net prices. Goods may be subject to import duties or additional taxes/fees which the customer shall pay additionally upon receipt of the goods. 

• Purchase price, along with shipping and handling charges are immediately payable, without deduction.

 Payment

• Payment will be made by the customer through Paypal Express Checkout. Blackbird Tees reserves the right to limit the method of payment chosen by the customer depending on order value, shipment region or other objective criteria. Should the customer have insufficient funds or choose a method of payment within Paypal that in any way slows the process of validation of payment, Blackbird Tees is not responsible for any delay that may occur in the completion of that order. Blackbird Tees will only process an order when payment has been completed and validated through Paypal. 

• Blackbird Tees is entitled to make use of the services of trustworthy third parties, in this case Paypal, for the handling of the payment.

Submissions

We welcome your comments regarding the Blackbird Tees website (www.blackbirdtees.com). However, any comments, feedback, notes, messages, ideas, suggestions or other communications (collectively, "Comments") sent to Blackbird Tees shall be and remain the exclusive property of Blackbird Tees. Your submission of any such Comments shall constitute an assignment to Blackbird Tees (www.blackbirdtees.com) of all worldwide rights, titles and interests in all copyrights and other intellectual property rights in the Comments. Blackbird Tees will be entitled to use, reproduce, disclose, publish and distribute any material you submit for any purpose whatsoever, without restriction and without compensating you in any way. For this reason, we ask that you not send us any comments that you do not wish to assign to us, including any confidential information or any original creative materials such as stories, product ideas, computer code or original artwork.

Colors

We have made every effort to display as accurately as possible the colors of our products that appear at the Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate.

Inaccuracy Disclaimer

From time to time there may be information on the Blackbird Tees website (www.blackbirdtees.com) that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order). We apologize for any inconvenience this may cause you. If you are not completely satisfied with your Blackbird Tees purchase you may return it with your invoice by mail. Conditional Sale 

• Up to the payment of any monies owed to Blackbird Tees and the order is shipped, the goods remain the property of Blackbird Tees.

  Limitation of Liability 

• Blackbird Tees only bears responsibility for damages, no matter what the legal ground, in the case of deliberate action and gross negligence. Blackbird Tees’ liability is limited to the payment of the foreseeable, typically occurring damage.

• If Blackbird Tees produces a damaged or faulty product, then the customer is entitled to a refund or exchange for an item of equal or lesser value. Because Blackbird Tees offers an option to customize garments, it is the sole responsibility of the customer to edit and format any and all custom material. If grammatical, formatting or any other type of customization error on the part of the customer occurs, this is not the responsibility of Blackbird Tees, and does not in any way entitle the customer to a refund or exchange.

Customer Information

Blackbird Tees uses personal data of the customer for appropriate purposes and according to statutory regulations. The personal data given (i.e. name, e-mail address, mailing address, bank details) for ordering products are used by Blackbird Tees for fulfilment and handling of the contract. This data is treated confidentially by Blackbird Tees and is not given to any third parties who are not part of the ordering, delivery and payment procedures. The customer shall be entitled to access information on the personal data which Blackbird Tees has saved by logging into their account. Moreover, they are entitled to the correction of incorrect data, and the blocking and deletion of their personal data, insofar as there is no legal obligation to retain such data.

Indemnification

You agree to defend, indemnify and hold Blackbird Tees harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your use of this site.
